General terms and conditions

§ 1 Scope

1. For goods bought via our online shop the following general terms and conditions exclusively apply in the version which has been valid at the moment of the order.

2. Should individual clauses of these general terms and conditions be ineffective, this does not prejudice the effectiveness of the other provisions and contracts based on these terms and conditions.

§ 2 Definitions

Consumers in the sense of these terms and conditions are natural persons, with whom a business relationship is entered without having an attributable commercial or self-employed occupation.

§ 3 Conclusion of contract

1. The offers of our online shop represent a non-binding request for customers to order goods.

2. With the placement of an order in our online shop, the customer submits a binding offer to us for the conclusion of a contract with him.

3. The automatic generated email that the customer receives directly after the order placement is at once the order confirmation. With this email the sale contract is concluded.

4. When using the online payment service PayPal the sale contract deemed to be bindingly offered on the part of the customer, when the payment process is completed. At the moment when we receive permanently the full invoice amount the sale contract is concluded.

5. When ordering at our online shop the order transaction has a total of 6 steps. At the first step the customer can choose the desired goods. By clicking the button 'Add to card' the goods can be added to the shopping card. The shopping card can be reviewed and edited at any time. At the second step new customers can create a customer account or existing customers can log into their customer account by entering their login details. At the third step the delivery address and the billing address can be chosen and edited. At the fourth step the carrier can be chosen and the associated shipping cost will be displayed. At the fifth step the payment method can be chosen. At the sixth step a shopping summary will be displayed and the customer has the possibility to check all order details and edit them if necessary. The customer has also the possibility to cancel the order at any time by closing the browser. By clicking the button 'Buy' the order process will be completed.

§ 4 Storage and accessibility of the order data

Orders and the details of the contract (type of product, price, quantity et cetera) will be stored by us. Registered customers have the possibility to access their order data through the login area (my account).

§ 5 Retention of title

The delivered goods remains our property until the payment of the full invoice amount is completed.

§ 6 Prices and shipping costs

All prices stated are final prices excl. shipping costs. Because of the small business owner state according to § 19 UStG (Value Added Tax Act in Germany) we charge no sales tax and therefore do not account it. The specific shipping costs for the respective delivery areas can be seen at our online shop. When shipping to countries outside the EU, additional toll costs may occur.

§ 7 Conditions of delivery

Unless otherwise noted the ordered goods will be shipped within 2 working days after we received the payment of the full invoice amount.

§ 8 Conditions of payment

Payment is to be made either per cash in advance via bank transfer (only possible within Germany) or per PayPal (possible worldwide). We shall reserve the right to accept or refuse certain payment methods in individual cases. If you choose payment in advance as method of payment, we will send you our bank details in the order confirmation email. The invoice amount has to be transferred to our bank account within 10 days. A right of retention may only be applied, if the counterclaim is based on the same contractual relationship.

§ 9 Warranty

The warranty is based on the statutory provisions.

§ 10 Right of withdrawal

You have the right to withdraw this contract within 30 days without stating reasons.

The withdrawal period is 30 days from the day, on which you or a nominated third parties, other than the carrier, have/has received the last goods.

To exercise the right of withdrawal, you have to provide us

with a clear statement (e.g. via letter mail, telefax or email) of your decision to withdraw from this contract. You can use the enclosed standard withdrawal form for it, but it's not obligated to do.

In order to observe the withdrawal period, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the withdrawal period has expired.

Consequences of withdrawal   

If you withdraw this contract, we have to refund all payments received from you including the shipping costs (with the exception of additional costs that exceed our standard delivery method) immediately and at the latest within 14 days of receipt of your contract withdrawal. For the refundment we will use the same instrument of payment that you have used for the original transaction unless expressly otherwise agreed; we will never charge you fees for this refundment. We may withhold the refundment until we have received the goods or until you have provided evidence that you have sent back the goods, depending which is the earliest.

The withdrawal period is met if the goods are sent back within the 30 day withdrawal period. You have to pay for the immediate costs of the return shipment.

The consumer shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to ascertain the nature, features and functioning of the goods.  

Exceptions from the right of withdrawal

The right of withdrawal does not apply to distance contracts for the delivery of sealed goods, which are not suited for returning because of reasons in terms of health protection and hygiene, once the seal is removed after delivery.

1. Personal data is collected, stored and processed exclusively within the framework of the legal regulations of the German Federal Data Protection Act (BDSG) and the Telemedia Act (TMG).

2. Every visit to our website and every access or download of a file accessible through the website is automatically recorded. This storage is being done for internal system-related and statistical purposes only. The following data will be logged: Name of requested file, date and time of request, volume of data, report of successful transfer, web browser and the requesting domain. § 12 Period of retention of personal data

All personal data collected via this website is only stored as long as necessary for the purposes for which it was provided. In the case of the storage periods required under commercial and tax law, certain data may be stored for up to 10 years.

§ 13 Your rights

In case you do not agree anymore with the storage of your personal data or the data has become inaccurate we will delete, correct or interlock it on demand provided that the storage is not required by law. As far as we refer or link to third parties websites from our online shop, we can assume no warranty or liability for the accuracy or completeness of the contents or the data security of them. We have no influence on the content used by third parties and their adherence to the data protection regulations and therefore request that you check out the data privacy statement of third parties provider.

§ 15 Applicable law and jurisdiction

German law shall apply. This agreement on applicable law only applies in so far as the consumer is not deprived of the protection granted by the law of the country in which he is customarily domiciled. Insofar as the customer is not a consumer the courts in Berlin shall have jurisdiction
